Browsing the website and purchasing products implies acceptance of these Terms of Service.

From now on, the terms “the company”, “we”, “us” and “our” refer to PiSUKA CREACIONES S.L. The term “Services” refers to the services offered in this online store and the term “Products” refers to the products offered for sale in this online store.

By accepting these Terms of Service, you represent that you are at least the legal age of majority in your place of residence and have given us your consent to allow any of your minor dependents to use the Services on devices that you own, purchase, or manage.

4. Purchase process

  3. Enter your shipping and billing information.

  4. Select your shipping and payment method.

  5. Review the order summary and confirm the purchase.

  6. Before finalizing the order, you can correct any data entered.

  7. After completing your payment, you will receive a confirmation email with your order details. We recommend that you keep it.

When you place an order, you are making a purchase. PiSUKA CREACIONES S.L. reserves the right to accept or reject your order for any reason, at its sole discretion. We must receive and process your payment before accepting your order. You should review your orders carefully before making a purchase, as PiSUKA CREACIONES S.L. may not be able to process a cancellation request after an order has been accepted. In the event that we do not accept, change, or cancel an order, we will attempt to notify you by contacting you via the email address or phone number you provided when placing the order.

You may return or exchange your purchase only in accordance with our refund policy.

You represent and warrant that your purchase is for your personal or domestic use and not for resale or commercial export.

5. Price, taxes and invoicing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be indicated in the order confirmation sent to you by email. Unless expressly stated otherwise, published prices include VAT but do not include other taxes (if any), shipping, handling, customs, or import duties.

Prices displayed on our online stores may differ from prices offered in our physical stores, online stores, or other stores operated by third parties. We may occasionally offer promotions on the Services that may affect pricing strategies and are governed by terms and conditions that differ from these Terms. If there is a conflict between the terms of a promotion and these Terms, the terms of the promotion will prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transaction and contact you as needed.

We reserve the right to modify prices and offers on the website, but changes will not affect orders that have already been confirmed.

You represent and warrant that (i) the payment method information you provide is true, correct and complete, (ii) you are duly authorized to use such payment method, (iii) the charges you incur will be accepted by your payment method company and (iv) you will pay the charges you incur at the published prices, including shipping and handling charges and all applicable taxes, if any.

7. Shipping and Delivery

Orders are prepared for shipment within 24 hours (business days). Order cut-off time is at 12:00 local time. Shipping costs and estimated delivery times will be displayed before you confirm your order and may vary depending on the destination.

We are not responsible for any shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We will not be liable for delays caused by the shipping company, customs procedures, or events beyond our control.

You are responsible for providing an accurate shipping address. We are not responsible for shipments lost due to an incorrect address. Once we transfer the goods to the shipping company, title to the goods and the risk of loss are transferred to you.

8. Product Availability

Product availability is shown on each product page. In the event of a stock shortage after order confirmation, we will inform you as soon as possible.

  • To propose an alternative product with similar characteristics, or

  • We can refund the corresponding amount if you prefer. In these cases, the refund will be issued via the same payment method used, within a maximum of three business days from your selection.

9. Right of withdrawal (return)

When buying as a consumer, you have a period of 30 calendar days  from the moment you receive the product, you can return it without needing to state the reason.

Details, costs, and instructions for making a return are listed on our website. Refund Policy, whose content forms part of these Terms of Service. Under no circumstances may the conditions and terms indicated on that page imply a reduction in the rights of the consumer.

Exceptions to withdrawal

The right of withdrawal does not apply in cases provided for by law, such as personalized products or products clearly made to the consumer's specifications, or items that for hygiene reasons cannot be returned once unsealed.

10. Defective products or shipping errors

If you receive a defective, damaged, or different product than the one ordered, please contact us using any of the methods indicated in the contact page from the online store (email, phone, Whatsapp) indicating the order number, the problem detected and, if possible, photographs of the defect or the condition of the package.

After verification, we will inform you of the return or collection method. In these cases, the return and reshipping costs are covered by us.

We may offer you, as appropriate, repair, replacement, price reduction or termination of the contract, in accordance with consumer regulations.

11. Legal guarantee

The products are covered by the legal guarantee established by consumer protection regulations. If the product is defective, you must inform us within a reasonable time after discovering the problem.

To process a warranty claim, please contact us through any of the methods indicated in the contact page from the online store (email, phone, WhatsApp), please provide the order number, a description of the problem, and, if possible, photos of the defect. We will then guide you through the product evaluation process.

Once analyzed, we will inform you of the solution: repair, replacement, price reduction or termination of the contract.

The warranty does not cover, among other things, damage resulting from improper use, lack of maintenance, normal wear and tear, or improper handling of the product.

The name, logo, product and service names, designs, and slogans of Shopify are registered trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are registered trademarks of their respective owners.

You may be provided access to customer tools offered by third parties as part of the Services, which we do not monitor or have any control or input over.

The Pies Sucios store and website operates using Shopify technology, which allows us to offer you the Services. However, any sale or purchase you make on our store is conducted directly with PiSUKA CREACIONES S.L. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and PiSUKA CREACIONES S.L., including any injury, damage, or loss resulting from the purchase of products and services. You hereby expressly release Shopify and its affiliates from any and all claims, damages, and liabilities arising out of or related to your purchase and transaction with PiSUKA CREACIONES S.L.

We will not be responsible for:

When the customer has the status of a consumer, these conditions will be governed by Spanish legislation on consumers and users, and any conflict will be submitted to the courts and tribunals of the consumer's domicile.
In other cases (non-consumer clients), the parties must submit to the courts and tribunals of Murcia.
